General conditions of sale of products sold on www.philaeparis.com

Section 1 - Objet

The present conditions govern the sales by PHILAE
149, Boulevard MALESHERBES 75017 PARIS

(fantasy jewels and fashion accessories sold on the website : www.philaeparis.com). 

Section 2 - Prices

The prices of our products are indicated with taxes included (VAT and other taxes applicable on the day of the order), unless otherwise indicated and excluding processing and shipping costs. 

In case of an order to a country other than metropolitan France, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be applied. These rights and charges are not the responsibility of PHILAE.

They will be at your charge and are your entire responsibility, both in terms of declarations and payments to the authorities and competent institutions in your country. We advise you to get information on these aspects from your local authorities. 

All orders, regardless of their provenance, are payable in Euros.  

PHILAE reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the price in effect at the time the order is validated and under reserve of availability. 

The products remain the property of PHILAE until full payment is received.  

Warning: as soon as you take physical possession of the ordered products, the risks of loss or damage to the products are transferred to you.

Section 3 - Orders

The contractual information is presented in French and will be confirmed at the time of validation of your order. 

PHILAE reserves the right not to register a payment, and to cancel or not to confirm an order for any reason whatsoever, and more particularly in case of supply problems, or in case of difficulty concerning the order received.

Section 4 - Validation of your order

Any order appearing on the Internet site www.philaeparis.com supposes the adhesion to the present General Conditions. Any confirmation of order involves your full and complete adhesion to the present general conditions of sale, without exception or reserve.  

All the data provided and the entered confirmation will be worth proof of the transaction. 

You declare that you are fully aware of this.  

The confirmation of the order will be worth signature and acceptance of the operations conducted.  

A summary of the information of your order will be communicated to you at the e-mail address of confirmation of your order. 

Section 5 - Payment

The validation of your order implies for you the obligation to pay the indicated price.  

The payment of your purchases is made by credit card through a secure system.

The card is debited at the time of the online payment.

Section 6 - Withdrawal

In accordance with the stipulations of article L.121-21 of the French Consumer Code, you have a 14-day cooling-off period from the date of receipt of your products to exercise your right of withdrawal without having to justify your reasons or pay a penalty.  

Returns must be made in their original condition and complete (packaging, accessories) and without having been used (worn). In this context, your responsibility is engaged. Any damage suffered by the product on this occasion may be of a nature to defeat the right of withdrawal. 

The return costs are at your expense.

If you exercise your right of withdrawal, PHILAE will reimburse the sums paid within 14 days following notification of your request and receipt of the product, using the same means of payment as used for the order. 

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL  

In accordance with the provisions of article L.121-21-8 of the Consumer Code, the right of withdrawal does not apply to:

  • The supply of services fully executed before the end of the withdrawal period and whose execution has begun after explicit prior agreement of the consumer and explicit waiver of his right of withdrawal.
  • The supply of goods made to the specifications of the consumer or clearly personalized.
  • The supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection.
  • The supply of goods which, after delivery and by their nature, are indissociably mixed with other articles.

Section 7- Availability

Our products are offered as long as they are displayed on the site www.philaeparis.com and within the limits of available stocks. For products not stocked, our offers are only available if they are in stock through our suppliers.

In case of unavailability of product after placing your order, we will inform you by mail. Your order will be automatically cancelled and no credit card charge will be made. If necessary, the refund is made. 

Section 8 - Delivery

The products are sent to the delivery address indicated during the ordering process, within the following time limits:

  • as an indication: usually 3 to 6 working days for metropolitan France,
  • as a contractual obligation, 15 working days for metropolitan France, 20 working days for other destinations. 

In case of delay in shipping, an email will be sent to you to inform you of a possible consequence on the delivery time.  

In conformity with the legal provisions, in the case of delay of delivery compared to the contractual time, you will have the possibility of cancelling the order in the conditions and modalities defined in the article L 138-2 of the Code of the Consumption. If in the meantime you receive the product we will proceed to its refund and the refund of the transport costs under the conditions of the article L 138-3 of the Code of the Consumption. 

In the case of deliveries by a carrier, PHILAE cannot be held responsible for delays in delivery due exclusively to the client's unavailability after several proposed appointments.  

Section 9 - Warranty

All our products benefit from the legal guarantee of conformity and the guarantee of the hidden defects, envisaged by articles 1641 and following of the Civil code. In case of non-conformity of a product sold, it can be returned, exchanged or refunded.  

All claims, requests for exchange or refund must be made by Post to PHILAE, 149 Bld Malesherbes 75017 Paris within 30 days of delivery.  

The products must be returned to us in the condition in which you received them with all the elements (accessories, packaging, instructions...). The shipping costs will be reimbursed to you on the basis of the invoiced cost and the return fees will be reimbursed to you on presentation of the receipts. 

The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided in Section 6. 

Section 10 - Liability

The products proposed comply with current French legislation. PHILAE cannot be held responsible in the event of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities regarding the possibility of importing or using the products or services you are considering ordering. 

Furthermore, PHILAE shall not be held responsible for any damage resulting from improper use of the product purchased. 

Finally, PHILAE cannot be held responsible for any inconvenience or damage inherent to the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses. 

Section 11 - Applicable law in case of conflict

The original language of this contract is the French language. The present conditions of sale are subject to French law. In case of dispute, the French courts will have exclusive jurisdiction. 

Section 12 - Intellectual property

All elements of the www.philaeparis.com website are and remain the exclusive intellectual property of PHILAE. No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site, whether software, visual, or sound. Any simple link or hypertext link is strictly prohibited without the explicit written consent of PHILAE.

Section 13 - Personal data

PHILAE reserves the right to collect nominative information and personal data about you. This information is necessary to manage your order and to improve the services and information we send you.  

It may also be transmitted to companies that contribute to this relationship, such as those responsible for the execution of services and orders for their management, execution, processing and payment.  

This information and data is also kept for security purposes, in order to comply with legal and regulatory obligations.  

In accordance with the law of January 6, 1978, you have the right to access, rectify and object to the nominative information and personal data concerning you, directly on the Internet site. 

Section 14 - Archiving evidence

PHILAE will archive purchase receipts and billing documents on a reliable and durable medium constituting a true copy in accordance with the provisions of Article 1348 of the French Civil Code.  

PHILAE's computerized records will be considered by all parties concerned as proof of communications, orders, payments and transactions between the parties.
